Beneficiary's Right to see the Will or Trust

Under Utah Law, an "Interested Person" as defined under Utah Code Annotated 75-1-201  has a right to obtain a copy of the will, after following the process provided for under Utah Code Annotated 75-2-902. A "Qualified Beneficiary," as defined under Utah Code Annotated 75-7-103 has a right to see a copy of the trust as provided under Utah Code Annotated 75-7-811(2).  Trustees and Executors should be cautious in providing a copy of the trust or will because they have a fiduciary responsibility to keep them private and confidential.

Request to see the Will or Trust

Executor's and Trustees are reluctant to provide copies of the will or trust because they are responsible for keeping them private and confidential.  In the case of a will, an executor might argue that there is no requirement to deliver a will until after they undergo a proceeding before a judge.  Beneficiaries might try utilizing the following form to request a copy of the will or trust.
